However, BII does not endorse any of the suppliers contained in this site and expects visitors to take reasonable precautions before entering into any agreement with them. BII does not accept liability for any disputes arising from the use of these suppliers. BII reserves the right to withdraw any supplier from its site at its discretion and without notice. Information about the Terms and Conditions

These terms and conditions (“Terms”) describe what the BIIAB Course Brokerage (the

Service”) does for you, and the terms which you accept by using or making a booking through this Service.

In these Terms “you” means the individual, company or organisation accessing the Service, or on whose behalf a course booking is made through the Service.

These Terms constitute a legally binding agreement between you and BIIAB. If you do not wish to accept these Terms then you should immediately stop using this Service. By continuing to use this Service you agree to be bound by, and accept, these Terms.

You may not use our website or the Service if you are under the age of 18 or you are not able to form legally binding contracts, or if your access to the Service has been suspended by BIIAB.

 

The BIIAB Course Brokerage

The Service is operated by BIIAB, a limited company incorporated in England and Wales,

Company Registration Number 06409529, whose registered office is at BII,  Infor House,  1 Lakeside Road,  Farnborough,  GU14 6XP (“BIIAB” or “we”).

Through the Service BIIAB makes available information about the potential availability of places on courses leading to BIIAB accredited qualifications (“Courses”) conducted by BIIAB approved course providers in England, Wales, Scotland and Northern Ireland (each known as a “Course Provider”), and enables bookings for such Courses to be made.

In using the Service you fully accept and understand that this is a portal to third party Course Providers, and that BIIAB is only acting as the agent for the relevant Course Provider. When you make a booking for a Course the party legally responsible to you for providing the Course is the relevant Course Provider, and not BIIAB.

 

Terms and Conditions of Booking

When you make a booking through the Service, you will be sent an e-mail acknowledging your booking. Your booking represents an offer to BIIAB as agent for the relevant Course Provider to purchase a place (or places) on a Course run by a BIIAB approved Course Provider. Your booking is only accepted when you receive an e-mail confirmation that your place on the relevant Course has been confirmed.

The availability of places on any particular Course is constantly changing and there is a chance that a booking may not be successful, particularly if the Course is due to take place very close to the time of booking. Should your initial booking be unsuccessful you will be notified and we may offer you an alternative to best match your requirements, but you are not obliged to accept an alternative.

It is essential that you provide us with a valid and current e-mail address, which we can use to communicate with you on any matters relating to your booking. It is your responsibility to advise us of any changes to your email address, or other contact details.

 

Payment

We are only able to accept payment through a valid UK debit or credit card. In addition to the course fee shown we will charge VAT at the applicable rate, and may also levy an additional charge to reflect the charges levied by credit or debit card operators. Any such additional charge will be clearly shown.

Full payment will be required at the time of booking and BIIAB is unable to offer credit terms.

If for any reason having taken payment from you your credit card or debit card payment is declined BIIAB reserves the right to cancel the place(s) on the Course which you booked through the Service.

 

Cancellation, Rescheduling and Refund Policy

You have the right to cancel a booking within seven (7) working days from the day after we send you confirmation that your booking for a Course has been accepted. In this case BIIAB will refund you the full cost of your booking to the credit card or debit card whose details you supplied at the time of booking. If, however, before you notify BIIAB of a cancellation you have already started your attendance on the relevant Course then no refund will be given. Refunds will only be made to the original credit card or debit card used to make the booking and we do not make refunds by cheque, cash or bank transfer.

Subject to the aforementioned 7 day cancellation period, the following refund policy shall apply:

Cancellation must be notified to us in writing by letter or e-mail – but not by telephone. Notification should be sent to BIIAB Course Brokerage, BII,  Infor House,  1 Lakeside Road,  Farnborough,  GU14 6XP or by email to customersupport@bii.org. When doing so you should state your name, address, Course details, booking reference and the reason for cancellation. In order to qualify for the refund detailed above you must have returned to the relevant Course Provider intact all course materials that were sent to you by the Course Provider. If you do not return such course materials then the cost of those materials may deducted from any refund.

BIIAB’s cancellation policy does not affect your statutory rights.

Although rare, from time to time Course Providers may need to cancel or reschedule a Course. Should a Course be cancelled for any reason you will be fully reimbursed to the full value of the Course fees, VAT and any card fees paid, unless a Course reschedule is acceptable and agreed between you and the Course Provider. This is the full extent of the liability, which BIIAB has for any indirect, incidental, punitive, special or consequential losses or damages arising from a Course cancellation or rescheduled Course.

 

Course Information

Information relating to Courses provided through the Service is provided by Course Providers and BIIAB cannot be held responsible for any errors in this information. Courses are non-residential unless explicitly stated in the course overview or course description. Refreshments and a light lunch are typically provided on full day courses, but cannot be guaranteed.

 

Specific Course Requirements

Some Courses may have very specific prerequisites or terms and conditions attached, for example, specific experience or qualifications might be necessary for some courses and health requirements might exist for certain practical courses. Where such prerequisites exist they will be outlined in the general information relating to the Course. By booking the Course you will be signifying that you are aware of and are able to meet the prerequisites for the Course. You should not book a Course if you are uncertain if you meet these terms.

 

Quality of Courses

Whilst BIIAB monitors the quality of Courses being delivered by accredited Course Providers, we cannot accept any responsibility or liability for the actions and services of Course Providers promoting their courses through this Service. If you have any complaint about a Course booked through the Service your first recourse should be to contact the relevant Course Provider. We will, however, endeavour where possible to resolve any quality issues arising from the use of the Service to book your Course with a Course Provider, if you are unable to resolve the matter directly with the Course Provider.

 

Protecting your password

When you place a booking through the Service you will be issued with a user name and password to protect your secure account. You are responsible for maintaining the confidentiality of your password. If you become aware of any unauthorised use of your password, we recommend that you contact us immediately on 01276 684449.

 

Privacy

We value your privacy. You must read our Privacy Policy which contains important information about the use of your personal data and other information regarding your privacy and our security processes and policies.

 

Web Site Licensing, Access and Use

You must at all times use the Service in a responsible and legal manner. In particular, but not exclusively you as a user must not:

  • misrepresent your identity or affiliation with any other person or organisation;
  • use the Service to send junk email or 'spam' to people who do not wish to receive emails from you;
  • use the Service to conduct, display or forward surveys, raffles, lotteries, contests, pyramid schemes or chain letters;
  • interfere with, or disrupt, the Service or services or networks connected to the Service and introduce any computer virus (including any variant or similar malicious code or instructions) to the Service;

BIIAB reserves the right to terminate your access to the Service without notice in the event of a breach of the above rules.

Use of Service includes, viewing the information, making bookings, reviewing bookings and changing bookings through the Service. You may only establish links to the Service only with prior written consent from BIIAB.

 

Copyright

Your use of the Service and its contents grants no rights to you in relation to our intellectual property rights including, without limitation, trademarks, logos, graphics, photographs, animations, videos and text or the intellectual property of third parties in the Website and its contents.

The copyright of the material contained on the BIIAB Course Brokerage website belongs to BIIAB or its Course Providers, as appropriate, and may not be copied without permission.

By using the Service you agree not to access, monitor or copy information for your own commercial benefit or the benefit of another party or to use any data mining, robots, spiders, scrapers or other automated data gathering and extraction tools, without prior written permission. You also agree not to make any attempts to attack the infrastructure of the web site.

 

Disclaimer and Limitation of Liability

BIIAB does not, and nothing in these Terms shall act to, exclude or limit BIIAB's liability for death or personal injury resulting from its negligence, fraud or any other liability which may not by applicable law be excluded or limited.

You agree that your use of the Service is on an "as is" and "as available" basis and that your use of the Service is at your sole risk. BIIAB does not guarantee continuous uninterrupted or secure access to the Service and operation of the Service may be interfered with by numerous factors outside of our control.

BIIAB does not provide conditions, warranties or other terms in relation to any of the Courses promoted by Course Providers through the Service to the fullest extent permissible by law. You are solely responsible for considering whether a particular Course is suitable for you and BIIAB gives no warranty as to the suitability of any particular course.

Subject to exceptions listed above, in no event shall BIIAB be liable (whether for breach of contract, negligence or for any other reason) for any loss or damage which you may claim to have suffered by reason of your accessing and use of the Service, including (but not limited to) loss of profits, exemplary or special damages, loss of sales, loss of revenue, loss of goodwill, loss of any software or data, loss of bargain, loss of opportunity, loss of or waste of management or other staff time, or for any indirect, consequential or special loss, however arising.

 

Applicable Law and Jurisdiction

These Terms are governed by and construed in accordance with English law. Access is further conditional on your agreement that any dispute or matter which arises will be dealt with by the Courts of England and Wales to the exclusion of the courts of any other country.

 

Changes and Updates to these Terms

These Terms may be updated from time to time, and the terms and conditions prevailing at the time of booking will apply.

 

BIIAB Course Brokerage – Privacy Policy

Privacy Policy

BIIAB takes your privacy and your personal data very seriously. We operate and are registered in accordance with UK Data Protection Act 1998.

This Privacy Policy is incorporated into and is subject to the BIIAB Course Brokerage Terms and Conditions, and words and phrases used in this Privacy Policy will have the same meaning as in the BIIAB Course Brokerage Terms and Conditions.

 

Collection and use of your personal data

We collect data from a variety of different sources, which might include personal data. To process bookings for Courses we need to collect certain personal information about you, such as your name, telephone numbers, addresses, and credit/debit card details. This is a necessary part of processing bookings for Courses and providing you and Course Providers with the Service.

When you place a booking for a Course we must provide certain personal data to the Course Provider who’s Course you have booked to enable them to enrol you on the Course and to send you joining information, and by making a booking through the Service you expressly consent to this.

BIIAB will not sell, rent or trade your personal information to third parties for marketing purposes without your express consent.

If consent is obtained for using your personal information for marketing purposes, we may also use the information you provide to tell you about other Courses, offers from BIIAB or its group. We will always try to provide only details of Courses, offers and promotions which we think will be of interest to you, and you may de-register from receiving marketing information by sending an email to customersupport@bii.org. This will normally be actioned within 1 working day.

 

What are cookies and how do we use them?

A cookie is a small amount of information which is sent to your browser from a website's computers and stored on your computer's hard drive.

These cookies help us to improve our website and to deliver a better and more personalised service. They enable us to: (a) assess usage patterns; (b) store information about your preferences, and so allow us to customise our website according to your individual interests; (c) speed up your searches; and (d) recognise you when you return to the Service.
